The approaches adopted in the User Agreement apply to capitalized terms used but not otherwise specified in this document.
As a buyer, you acknowledge and agree that when you start a transaction on the website and /or mobile app, you are starting a contract that is enforceable and legally binding with the seller to buy the items from the seller using either payment on billing or payment on delivery as the method of payment to pay the transaction price, which must be paid to the seller through your issuing bank (except in case of cash payments). You concur and agree to the Company’s position that it just serves as a channel for the collection and transfer of the transaction price. On the transaction price that the Company receives through and of the prescribed payment methods, the Buyer is not entitled to receive any interest or other benefits of any kind, nor is it permitted to do so.
By exchanging electronic records or conducting electronic communication using features that may be made available on the Website and /or mobile app, you and the seller can agree on the commercial terms of the transaction, including the terms of Dispatch and Delivery time or any extensions thereof, and the transaction will be amended accordingly. However, any such variation of the terms of the transaction must not violate the User Agreement or the rules and policies established thereunder.
Payment Method: For transactions made on the Website and /or mobile app, you must pay the transaction price using any one accepted payment method, either Payment on Billing or on Delivery. If you choose the Payment on the Billing, the Website and /or mobile app, will validate your choice, and you will be notified when the transaction is credited to the Company’s account or if you agree to pay the transaction price on delivery.
The Website and /or mobile app shall notify the Buyer of Non-payment: Buyers are not allowed to purchase any products without paying the transaction price by choosing either the Payment on Billing method or the Payment on Delivery option or by using any other payment method offered by the Company on the Website and /or mobile app, in respect of the product as described in the listing.
Contacting Other Users: Users must not contact other users outside of the Website and /or Mobile Application to warn them about a seller, product, or listing. You may, however, submit feedback and/or reviews/ratings for merchants using the feedback facilities provided on the Website and /or Mobile Application.
Contact Information: The contact information you submit on the Website or Mobile Application must be correct and up to date at all times, and you must immediately update any changes to your contact information on the Website and /or Mobile Application. The Company accepts no responsibility for any delay or non-delivery of products caused by the User’s failure to update the contact information supplied on the Website and /or Mobile Application, and any subsequent negative feedback provided by the customer will be deleted or modified.
Feedback: You must utilize the feedback and review mechanism to share your fair opinion and facts about any User or the Website and /or Mobile Application, or your experience while using the Website or Mobile Application, which you know exclusively from first-hand experience. In your feedback, you must not include any hearsay information or material that might be used to defame any User, brand, or product. You must immediately notify the Company at [email protected] if you become aware of a breach of any relevant laws or a violation of the provisions of this User Agreement and the rules and policies established thereunder.
Limit on transaction Volume: The Company reserves the right to limit the amount payable and the volume of transactions that a Buyer may conduct on a single Valid Card/ Valid Bank Account, and may refuse to process transactions that exceed such limits, as well as to block specific Valid Cards or Valid Bank Accounts that are suspected of being used fraudulently while paying the transaction price.
Payment verification: To avoid misuse, the transaction initiated by the Buyer may be flagged or held for additional checks and verification, in which the Company may contact the buyer for verification of additional information and documents. If such information, data, and documents are inaccurate, incorrect, or incomplete, the Company may refuse to confirm the payment, and the Valid Card or the Valid Bank Account will not be charged. In this instance, the Dispatch timeframes will not begin until Payment Confirmation is received.
The Company reserves the right to refuse to process transactions in respect of transactions by Buyers who have a prior history of questionable charges, including without limitation breach of any agreements with the Company, violation of any applicable law, or any charges imposed by the Issuing Bank.
Payment Confirmation: In the case of Payment on Billing, the Company shall notify the buyer and seller that the transaction price has been received upon successful receipt of the transaction by the Company from the Buyer on the transaction and completion of payment verification in accordance with the clause above. In the event of Payment on Delivery, the Company shall notify the buyer and seller that the buyer has agreed to pay the transaction price in this manner.
Dispatch Details: The Company shall disclose the Dispatch Details on the Website and /or Mobile Application within 7 days of the Payment Confirmation or within such deadlines as the buyer and seller may agree upon on the Website and /or Mobile Application. If the Seller fails to input the Dispatch Details on the Website and /or Mobile Application within the specified period, the Company may terminate the transaction and return the transaction price (if paid) to the Buyer at its sole discretion. In the case of delivery outside India, only online payments are accepted.
Delivery: The period of time in which the seller or the Company is required to ensure delivery of the items to the buyer shall be calculated from the time the seller or the Company enters the dispatch details on the Website and /or Mobile Application within a certain period as agreed upon between the buyer and seller and intimated on the Website and /or Mobile Application.
Delivery confirmation: If the item is delivered or not delivered within the allotted time, you must tell the Website and /or Mobile Application right away. It will be deemed in respect of the transaction and the price will not be refunded if you do not give this notification/ confirmation of receipt or non-receipt of an item within 7 days of the expiration of the delivery time. The Company will periodically update the shipment status for Cash on Delivery transactions, and the Buyer is not required to certify receipt of the products.
Refund: If you do not receive the Delivery within the time period specified in the transaction or within the time period set forth, you may be entitled to a refund of the transaction price within 7 days of the expiration of the Delivery time (including any extension). You will not be entitled to a refund if you do not submit a refund claim on the Website and /or Mobile Application within the allotted period.
The transaction will be cancelled and the item will be returned to the seller. The company and the seller will be entitled to recover reasonable compensation for services rendered and costs incurred for shipping, handling, couriering, processing, and packaging if you do not receive an item shipped to you due to your failure to make the required payment at the time of delivery, providing an inadequate or inaccurate shipping address, your non-availability at the address provided, or your failure to make the required payment in full at the time of delivery.
If a buyer has made an advance payment and is unable to accept delivery of the products despite our logistic partner or delivery executive’s best efforts, logistic costs will be deducted from the advance payment, and the remaining funds will be refunded to the buyer’s bank account.
The buyer has the right to request a refund for the total transaction price paid within 5 days of the Delivery time’s expiration if they have obtained delivery of the item within the allotted time frame of 48 hours. The Company may get in touch with the Users to verify. Following such verification, the Company may, in its sole discretion, accept or reject the reimbursement claim; the Users must not contest the Company’s decision. The transaction price will be returned to the customer if the refund claim is approved.
